Rent Escalation Clause

An escalation clause sets how much your rent rises each year. It is fair when the percentage and the frequency are both fixed in writing; it is a trap when the landlord can revise rent 'as mutually decided' or at will.

What it means in plain English

Most residential leases include an annual increase, commonly 5-10%. The problem is wording that leaves the number open, allows mid-term revisions, or ties the increase to an undefined 'market rate' the landlord determines.

Why it is risky

  • Open-ended escalation removes any ability to budget your housing cost.
  • Mid-term revision clauses let rent rise before the renewal date.
  • 'Market rate' without an index is effectively the landlord's opinion.
  • Compounding on a high base can outpace salary growth within two renewals.

Red-flag wording to look for

  • "Rent shall be revised at the time of renewal as mutually agreed or as decided by the Lessor."
  • "The Lessor reserves the right to revise the rent during the term upon thirty (30) days' notice."
  • "Rent shall be increased annually in line with prevailing market rates."

What fair wording looks like: A fixed percentage, applied once per twelve-month period, with a cap, and no mid-term revision.
